Use the service within its evidence boundaries.
These terms explain the agreement, permitted uses, payment responsibilities, and important limits that apply to ThinkProof.
Operator and acceptance
ThinkProof is owned and operated by CONNECTNEXA SOLUTIONS L.L.C.. These Terms form an agreement between you and CONNECTNEXA SOLUTIONS L.L.C.. By creating an account, joining a campaign, purchasing a plan, or using the service, you agree to these Terms and the policies linked from them. If you act for an organization, you represent that you have authority to bind it.
Eligibility
You must be at least 18 years old to create an account or use the public challenge. A participant under 18 may use the service only through a separately approved educational pilot with any consent and safeguards required by applicable law.
Developmental service
ThinkProof provides a scenario-based judgment challenge, related profiles, company workspaces, and pilot reporting. Features, scoring methods, timing, and availability may change as the service is evaluated and improved. Results are limited to the evidence observed in the stated challenge and should not be generalized beyond that context.
Permitted use
The service may be used for reflection, learning, professional development, research, and agreed organizational pilots. You must provide accurate account information, protect account access, follow participant notices, and use outputs only for the disclosed purpose.
Prohibited use
Do not use ThinkProof for hiring, promotion, termination, compensation, admission, grading, clinical care, legal advice, psychological diagnosis, intelligence testing, professional licensing, credit, insurance, housing, benefits, automated eligibility, surveillance, or another high-stakes decision for which it has not been validated. Do not use the service to discriminate, harass, retaliate, infer protected characteristics, rank people unfairly, violate privacy, or make a decision based solely on an automated output.
Organization responsibility
Organizations are responsible for lawful instructions, appropriate participant notice and consent, reasonable accommodations, access controls, authorized administrators, fair interpretation, and compliance with applicable employment, education, privacy, accessibility, consumer, and anti-discrimination laws. Organizations must not penalize a person for requesting an accommodation or declining an optional research use.
User content and confidentiality
You retain rights you already hold in information you submit. You grant CONNECTNEXA SOLUTIONS L.L.C. a limited permission to host, process, reproduce, and analyze that information only as needed to provide, secure, support, and improve the service consistent with the applicable notice. Do not submit information you lack authority to share, trade secrets that are unnecessary for the challenge, health records, government identifiers, payment-card numbers, or other highly sensitive information.
Payments, invoices, and taxes
ThinkProof plan names identify the service purchased. CONNECTNEXA SOLUTIONS L.L.C. is the legal seller and payment recipient. Payments are processed by a hosted payment provider, and invoices or receipts may show CONNECTNEXA SOLUTIONS L.L.C. together with the ThinkProof product name. Prices, participant capacity, delivery scope, and any taxes are shown before purchase. You are responsible for taxes not collected at checkout. The Refund Policy is part of these Terms.
Intellectual property
The service, scenarios, scoring structure, reports, branding, software, and related materials are owned by CONNECTNEXA SOLUTIONS L.L.C. or its licensors and are protected by applicable intellectual-property laws. Except for the access expressly provided with a plan, you may not copy, sell, reverse engineer, scrape, publish, or create competing assessment materials from protected service content.
Third-party services
The service may rely on hosting, authentication, form, email, payment, analytics, spreadsheet, and optional AI providers. Their availability and separate terms may affect parts of the service. Links to third-party services do not constitute an endorsement of unrelated content.
No professional advice
ThinkProof outputs are not legal, medical, clinical, psychological, employment, financial, educational, or other regulated professional advice, and they do not establish intelligence, fitness, competence, licensure, or future performance. Obtain qualified advice for decisions requiring regulated expertise.
Disclaimers
To the maximum extent permitted by law, the service is provided “as is” and “as available.” CONNECTNEXA SOLUTIONS L.L.C. does not warrant that the service will be uninterrupted, error-free, complete, secure in every circumstance, or suitable for a purpose outside the written scope. No profile, report, score, delivery date, or pilot outcome is guaranteed. Nothing in these Terms limits a right or warranty that applicable law does not allow us to exclude.
Limitation of liability
To the maximum extent permitted by law, CONNECTNEXA SOLUTIONS L.L.C. and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunity arising from the service. Aggregate liability for claims relating to the service will not exceed the greater of the amount you paid for the service during the 12 months before the event giving rise to the claim or US $100. This limitation does not apply where prohibited by law.
Indemnity for organizational misuse
To the extent permitted by law, an organization agrees to defend and indemnify CONNECTNEXA SOLUTIONS L.L.C. against third-party claims arising from that organization’s unlawful instructions, undisclosed high-stakes use, discriminatory or retaliatory use, breach of participant commitments, or content it lacked authority to provide. This does not apply to the extent a claim was caused by CONNECTNEXA SOLUTIONS L.L.C.’s own unlawful conduct.
Suspension and termination
We may limit or suspend access when reasonably necessary to protect participants, prevent misuse, investigate security concerns, comply with law, or address a material breach. You may stop using the service at any time; payment, confidentiality, intellectual-property, dispute, and liability provisions that by their nature should survive will continue to apply.
Changes and severability
We may update these Terms as the service or law changes. Material changes will be identified by an updated effective date and, when required, additional notice. If a provision is unenforceable, the remaining provisions remain in effect. A separate signed agreement controls if it expressly conflicts with these Terms.
